1.1. Welcome to ModMelonPlayground. These Terms of Use apply to your use of ModMelonPlayground Web and mobile applications and other content offered, websites and any related services (including servers, software and infrastructure) (hereinafter referred to as the “Service”). The use of the Service is also governed by the Privacy Policy or Privacy Policy of Mobile applications, which are included in this document by reference and can be found here for mobile applications and here for the website. ModMelonPlayground may add any sites to this list or remove any sites from it at its sole discretion at any time.
1.2. Please read these Terms of Use carefully before using the Service. By installing, using the Service or otherwise accessing it, you agree to the applicability and content of these Terms of Use, as well as the applicable privacy policy. Certain parts of the Service, such as web pages or portals where you can download games or pay for in-game credits, may contain additional terms and conditions from us or our suppliers, licensors or other third parties that supplement these Terms of Use. By using these services, you agree to comply with such additional terms and conditions. - REGISTRATION AND ACCOUNT
2.1. Subject to your consent and continued compliance with these Terms of Use and any other relevant policies and terms and conditions, ModMelonPlayground grants you a non-exclusive, non-transferable, non-sublicensable, revocable limited license subject to the restrictions below to access the Service and use it for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose. ModMelonPlayground offers a wide variety of mods for games on its portals and on other platforms such as app stores. These mods can be downloaded and installed for free, unless otherwise specified. However, you are solely responsible for any costs that you may incur by using the Service through any wireless or other communication service.
2.2. You can create an account on the Service (“Account”). By creating an account, you confirm that you are 16 years old or older.
2.3. The User name is a unique identifier chosen by you or provided by us, which is used to identify you on the Service. ModMelonPlayground reserves the right to delete any of your accounts if you have multiple accounts. You may not sell, rent or give away your account, create an account using a false identity or information, or on behalf of anyone other than yourself. Please inform us immediately if unauthorized access has been made to your account and change your registration details immediately. You are solely responsible for maintaining the confidentiality of login data and for any purchases made through your account, regardless of whether you are logged in or not. If you have provided us with contact information, you must keep it accurate and up-to-date. You must use your account only for non-commercial purposes.
2.4. ModMelonPlayground reserves the right to close and permanently deactivate your account if it has been inactive for 180 days. In case of deactivation, we are not obliged to save or provide any data or content related to your (former) account, or refund any payments made through your (former) account, and we may allow another user to register and use your former username. We also have no obligation to delete any publicly available data, content or other information that you have uploaded or posted on the Service.
2.5. Without limiting any other remedies, ModMelonPlayground may restrict, suspend, terminate, modify or delete accounts or access to the Service or parts thereof if you or ModMelonPlayground suspects that you are not complying with the Terms of Use, or for any actual or alleged illegal or improper use of the Service, without your consent notifications. ModMelonPlayground assumes no obligation to compensate you for any losses or results related to this, including, but not limited to, any benefits, privileges or virtual items related to your use of the Service.
- USER-GENERATED CONTENT
3.1. The Service may contain content from players (“User Content”), such as messages, mods and extensions for games, screenshots of the game process, video of the game process, opinion comments, images or graphics. We do not actively participate in the creation or publication of such user content, and we do not endorse any user content, nor do we guarantee that such content does not violate any rights of third parties or is not (otherwise) illegal. You use the Service at your own risk. By using the Service, you may encounter user content that is offensive, obscene or otherwise does not meet your expectations. You bear all risks associated with the use of any user content available in connection with the Service. ModMelonPlayground is not responsible for any user content.
3.2. If you submit any User Content yourself, you grant ModMelonPlayground a non-exclusive, irrevocable, perpetual, transferable, fully paid, royalty-free worldwide license (including the right to sublicense and transfer to third parties) to use, publish, reproduce, distribute, correct, prepare derivative works or otherwise use in any way such submitted user content. content or any part of it by any means and in all forms of media currently known or being developed in the future. To the extent permitted by applicable law, you hereby waive any moral rights or rights of publicity or privacy that you may have with respect to such user content.
3.3. Without prejudice to clause 3.2, you retain ownership of your user content. We have the right, but are not obligated, to edit, refuse to publish or delete any user content posted on the Service, at our sole discretion, for any reason at any time.
3.4. If you submit any user content to the Service, you:
● We acknowledge and agree that each user of the Service may have access to such user content and that ModMelonPlayground does not control this information or what users do with it;
● warrant that you are authorized to do so and grant ModMelonPlayground the license specified in clause 3.2, and that such content does not infringe any third party rights, including, but not limited to, any intellectual property rights, and does not violate any applicable law. You release ModMelonPlayground from the claims of any third party (including any authorities), related costs and damages.
3.5. Upon first request, you will cooperate with ModMelonPlayground in investigating any alleged illegal, fraudulent or inappropriate user content (whether from you or another player) or other activities on the Service. You release ModMelonPlayground and its officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, related costs and losses arising from or in any way related to any disputes with users of the Service or other third parties that may arise on the Service or in connection with with him.

Any download is carried out in accordance with the rules that accompany this particular content.

● reverse engineer, decompile, disassemble, decrypt or otherwise attempt to obtain the source code of any underlying software or other intellectual property used to provide the Service, or obtain any information from the Service in any way not explicitly permitted by ModMelonPlayground.
● Offer any form of advertising or promotion without our prior written consent;

● Use the Service in a way that may damage, disable or overload our servers or networks;

ModMelonPlayground reserves the right to determine what conduct it considers to be a violation of the Terms of Use or otherwise outside the intent or spirit of these Terms of Use. ModMelonPlayground reserves the right to take appropriate actions, which may include closing your account and prohibiting you from using the Service in whole or in part.
